Terms Of Traffic Service at KeyWordTargets.com

All orders for web traffic through KeyWordTargets.com are subject to the following terms and conditions:

This is a legal agreement between you and KeyWordTargets.com This agreement concerns your purchase of a service in which KeyWordTargets.com agrees to send visitors to a URL specified by you ("the service" or "the package").

NO POPUPS are allowed (unless campaign targeting was ordered to allow ONE popup), no sounds, no frame-breaking code, no inappropriate content (we determine what is appropriate). We reserve the right to stop a campaign at any time without refund.

Campaign start date - Due to variances in amounts of traffic purchased at different times, the starting date may fluctuate, and we are in no way to be held responsible if your campaign does not start by a specific date.

You are guaranteed that KeyWordTargets.com will send the number of visitors to the URL you specify within 30-90 days of the campaign starting date. All campaigns are on a first come first serve basis and the term of all campaigns at prices specified are a 30-60 day term under 100k. Campaigns from 100k to 500k are a 60 to 90 day term and campaigns from 500k to 1 million are 90 to 120 day term unless otherwise specified by rapid traffic or negotiated accordingly. This is the only guarantee for this service. In no event shall KeyWordTargets.com be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to, damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use the package, even if KeyWordTargets.com has been advised of the possibility of such damages.

If we are unable to deliver the number of visitors promised within 30-90 days of the campaign starting date, you may claim a refund. In the unlikely event that KeyWordTargets.com does not deliver the number of visitors promised, we will provide a refund of your entire purchase price on a pro-rata basis. In cases where refunds are claimed, we reserve the right to require proof that the proper numbers of visitors were not delivered. Stats, data and other information from third party counters (e.g. Extreme-DM.com, hitbox) are not sufficient to establish a claim. These counting systems tend to yield an improper count. If we dispute your claim, you must provide us with RAW server logs from the site and time period in question - this is the only reliable method of counting a visitor.

KeyWordTargets.com will not deliver visitors to sites with popup windows, unless the specific campaign package you order states that you are allowed exactly one popup window on the advertised site. Any additional window generated by your site shall be considered a popup window, including popunder windows and JavaScript alert windows. If a popup window is installed on the URL at any time, KeyWordTargets.com may stop the campaign and you will not be entitled to a refund.

KeyWordTargets.com will not deliver visitors to sites containing content that is not appropriate for viewing by a general audience, unless the specific campaign ordered was targeted to special audiences (i.e. FTC Restricted content). Inappropriate content includes, but is not limited to, adult content; hate text, illegal content (in the US) and content that encourages illegal activities or violence. What constitutes inappropriate content shall be determined at the sole discretion of KeyWordTargets.com. KeyWordTargets.com will review your site before beginning the campaign. If your site is changed during the campaign such that it includes inappropriate content, KeyWordTargets.com may stop your campaign immediately, with no refund being payable.

KeyWordTargets.com cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors to your URL. Such factors include, but are not limited to: downtime on your server, overuse of your bandwidth quota (if applicable), and errors on your site and network outages beyond our servers. Please contact your web hosting company or network provider if you are unsure about whether your hosting account is sufficient for the program you are ordering.

Resellers or Brokers of this service must include this exact TOS agreement on all order pages and provide a copy to all ordering customers. All prices are subject to change without notice.

This Agreement is the entire agreement between you and KeyWordTargets.com and supersedes any other understandings or agreements, including, but not limited to, advertising with respect to the package.

TERMINOLOGY: (1) In the present context, a visit generally occurs when a text file is loaded from your server (this includes HTML files). A hit occurs when a file is loaded from your web server. Since loading a single web page can cause several files to load (e.g. images), several hits usually occur when a page is loaded. Thus, the number of hits is always greater than (or equal to) the number of visits. The term "number of visitors" is interchangeable with the term "number of visits." Several "visits" may originate from a single IP address or individual. This generally occurs when an individual returns to or reloads a webpage. (2) "Pro-rata" refunds are calculated by dividing the number of visits we delivered by the number of visits you ordered. The result of this calculation is subtracted from 1 and the resulting figure is multiplied by your purchase price to derive the "pro-rata" refund.

If any provision of this Agreement is deemed invalid or unenforceable by any jurisdiction or government agency having jurisdiction, that particular provision will be deemed modified to the extent necessary to make the provision valid and enforceable, and the remaining provisions will remain in full force and effect.

ALL ORDERS THAT ARE PLACED THROUGH KeyWordTargets.com ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS. BY PLACING AN ORDER IT IS UNDERSTOOD THAT YOU HAVE READ, COMPREHENDED AND AGREED WITH THESE TERMS.

These TERM and CONDITIONS are an agreement between you ("CUSTOMER, CLIENT") and KeyWordTargets.com ("us"). They should be read and understood.

Client acknowledges that by placing an order with KeyWordTargets.com that they have read, acknowledged and fully understood ALL paragraphs of these TERMS AND CONDITIONS.

All campaigns are considered active the moment the first visitor (Hits/Traffic) is delivered to the client site.

Client is financially responsible for every hit / traffic delivered to their website. You agree to pay for all traffic that was sent to you or your customers website.

All traffic/hits will be delivered to the website address submitted with the order. In the event that there is an error with the submitted URL, the Client will not hold KeyWordTargets.com or it's Partner Sites responsible for the error. Any traffic delivered to a Client's site reflecting the above error, will not be credited or entitled to a refund.

In the event that the Client's site becomes unavailable for any reason ("server is down or unavailable, timed out, or shows to be active but with internal server errors, 404 errors and other types of common or uncommon errors associated with the internet and its underlying infrastructure"), the Client will not hold KeyWordTargets.com or its Partner Sites responsible for these errors. All/Any traffic delivered to the Client's site during this down time will not be credited or refunded.

In the event that any of the above errors occur including any errors not listed but clearly intended, the client may submit in writing a request for the campaign to be placed on hold. Upon resolution of the problem the held campaign will continue. ANY TRAFFIC PREVIOUSLY SENT WILL NOT BE CREDITED OR REFUNDED!

We use a state of the art tracking system to track your ad campaign. Each order is given a unique campaign id, which is used to track visitors to your site by day/time. When we provide an ad view, KeyWordTargets.com points the visitors to this campaign id.

The client understands that if the visitor viewing the ad closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part etc.), IT WILL COUNT AS AN AD VIEW ON OUR SYSTEM, WE HAVE SENT YOUR SITE TO THE VISITOR AND HAVE THEREFORE FULFILLED OUR OBLIGATION. It is important to note that this scenario may not appear in your website statistics. KeyWordTargets.com cannot control the acts of the individuals viewing your site and will not be held responsible for these actions.

Client understands that HIT COUNTERS on your site DO NOT ACCURATELY REPRESENT THE NUMBER OF VISITORS SENT TO YOUR SITE. This is due to the large amounts of traffic sent to the site in a relatively short timeframe. Client also understands that KeyWordTargets.com does not guarantee sales or signups and will not issue a refund if none are achieved.

Client acknowledges that the order is for the stated term. These terms and conditions are subject to change at any time after the stated term has ended.

In the event that there is a discrepancy between the amount of traffic delivered by KeyWordTargets.com, and the amount of traffic delivered to the Client, on their behalf, KeyWordTargets.com and the client both agree to use the report prepared by our ("KeyWordTargets.com") campaign manager to be the official report. The client understands and acknowledges that the campaign report received by KeyWordTargets.com to be true and accurate and agrees to hold KeyWordTargets.com, it's parent company as well as all companies and individuals involved harmless for any unexpected results arising from any advertising campaign.

Support staff is available virtually 24 hours/day, all requests must be made via sales@popunderadvertise.com. Client also understands that technical support may not be available at the exact time in which the client initiates contact. It is our policy to respond to all e-mails within 24-48 hours.

Client agrees to these terms of service and understands that they are legally binding.

KeyWordTargets.com will not promote spam, scam, hate, warez, hacking or any other site/offer that could be considered offensive to the most discriminate viewer. Any attempt to bypass our intended guidelines will result in account cancellation and no recourse for refund.

This agreement shall govern participation in the KeyWordTargets.com Guaranteed Visitors program. By participating in the Program you are agreeing to be bound by these Terms and Conditions. The term 'customer' shall refer to any individual or entity who accepts the terms and conditions of this Agreement by submitting the Program registration.

All orders that are placed through KeyWordTargets.com are subject to the following terms and conditions. By placing an order it is understood that you have read, comprehended and agreed with these terms.

These TERM and CONDITIONS are an agreement between you ("CUSTOMER, CLIENT") and KeyWordTargets.com ("us"). They should be read and understood.

PAYMENT:

All customers are required to pay one-hundred (100%) percent of the cost of the campaign before its activation. KeyWordTargets.com reserves the right to set and negotiate specific payment terms on a Customer-by-Customer basis.

PARTICIPATION:

KeyWordTargets.com shall have absolute discretion as to whether or not it accepts a particular customer or site for participation in the Network.

1.KeyWordTargets.com will not deliver visitors to the sites containing content that is not appropriate for viewing by a general audience. The following are examples (including but not limited to) of the type of sites we will not delivery visitors to:

Sites containing or linking to software piracy
Sites containing or linking to any form of illegal activity (i.e., how to build a bomb, hacking, 'phreaking', etc.) sites with gratuitous displays of violence, obscene or vulgar language, and abusive content or content which endorses or threatens physical harm.
Sites promoting any type of hate mongering (i.e., racial, political, ethnic, religious, gender-based, personal, etc.) Sites that participate in or transmit inappropriate newsgroup postings or unsolicited email (spam). Sites promoting any type of illegal substance or activity sites with illegal, false or deceptive investment advice and moneymaking opportunities. Sites with any type of content reasonable public consensus deem to be improper or inappropriate. All campaigns are considered active the moment the first visitor (Hits/Traffic) is delivered to the client site.

2. Your Advertisement Page my not contain any other Popup windows (unless you have purchased the Unlimited Popup options). Any additional window generated by your site shall be considered a popup window, including popups, pop-behinds, or exit popup windows. If a popup window is installed on the URL at any time, KeyWordTargets.com may stop the campaign and you will not be entitled to a refund.

3. Your Advertisement Page cannot have background music or sounds.

4. Your Advertisement Page cannot contain scripts that alter users browser settings.

5. Your Advertisement Page cannot contain any frame breaking codes.

6. TO insure compliance with these terms and conditions, any Customers that change their content after approval for membership MUST notify KeyWordTargets.com of the changes in writing IMMEDIATELY. If your site is changed during the campaign such that it includes inappropriate content, KeyWordTargets.com may stop your campaign immediately. In this case, you will not be entitled to a refund.

DATA REPORTING (STATS):

All Campaigns purchased on the Network are served, tracked and reported by us. We use a state of the art tracking system to track your ad campaign. Each order is given a unique campaign id which is used to track visitors to your site by day/time. When we provide an ad view, KeyWordTargets.com points the visitors to this campaign id.

Client is financially responsible for every hit / traffic delivered to their website. You agree to pay for all traffic that was sent to you plus you agree to pay 15% cancellation charge payable through Paypal (you must have a Paypal account) if you decide to cancel your order. Note you must have your campaign on PAUSE and provide us with your original payment information in order for us to promptly cancel your order.

In the event that any of the above errors occur including any errors not listed but clearly intended, the client may submit in writing a request for the campaign to be placed on hold. Upon resolution of the problem the held campaign will continue. Any traffic previously sent will not be credit or refunded.

The client understands that if the visitor viewing the ad closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part etc.), IT WILL COUNT AS AN AD VIEW ON OUR SYSTEM, WE HAVE SENT YOUR SITE TO THE VISITOR AND HAVE THEREFORE FULFILLED OUR OBLIGATION. It is important to note that this scenario may not appear in your website statistics.KeyWordTargets.com cannot control the acts of the individuals viewing your site and will not be held responsible for these actions.

Client understands that HIT COUNTERS on your site DO NOT ACCURATELY REPRESENT THE NUMBER OF VISITORS SENT TO YOUR SITE. This is due to the large amounts of traffic sent to the site in a relatively short timeframe. Client also understands that KeyWordTargets.com DOES NOT GUARANTEE SALES OR SIGNUPS AND WILL NOT ISSUE A FULL REFUND IF NONE ARE ACHIEVED!

We provide stats that are run direct between the server and your site and our stats are final as 3rd party stats/counters fail and prove unreliable in an offsite environment during high traffic stress. The only considerations for dispute are w/provision of server logs as we request and the confirmation in those logs of a 70% variance in total delivery count.

You must also understand that the way our system works your stats recording may not record each visitor since our traffic server is requesting your website ad and not the end user.

Know the limits of site,server, and hosting as this will greatly affect all and we hold no liability for any result due to inability to handle this traffic.

PAYMENT LIABILITY:

KeyWordTargets.com reserves the right to hold Customer and any agency, broker or other authorized representative of Customer jointly and severally liable for all amounts owed to KeyWordTargets.com.

CANCELLATION:

Any campaign canceled by Customer may be subject to a cancellation fee equal to 100% of that portion of the campaign scheduled to run during the three (3) day period following receipt by KeyWordTargets.com of written cancellation notice from Customer. Any traffic already used will not be refunded. If a cancellation occurs due to a violation of Terms and Conditions, you will not be entitled to a refund.

MONEY-BACK GUARANTEE:

While we are able to deliver traffic, and we guarantee to deliver targeted traffic, we do not guarantee sales of your product or service. We can guarantee that you will get the traffic you have purchased delivered to your site in the time you specify. If KeyWordTargets.com fails to deliver traffic to your website in the time specified on your original order, you have the option of either requesting that we extend the due date and complete your traffic delivery or we issue you a pro-rata refund on the undelivered portion with no questions asked!

RATES:

All advertising rates are subject to change at any time.

MINIMUM CTR:

KeyWordTargets.com does not guarantee minimum Click-through Ratio (CTR) for redirected visitors or any other service we provide.

GENERAL:

Client may not sell, assign or transfer any of the rights or services accompanying the purchase. Client may not change the content of the URL being advertised in any manner without prior written approval by KeyWordTargets.com authorized staff. Any attempt either by accident or design undermining the intention of this T.O.S. or the general principals that it was written for will result in immediate account deletion with no refund or adjustments available.

KeyWordTargets.com shall be permitted to identify Client as a KeyWordTargets.com Client and may use Client's name in connection with KeyWordTargets.com marketing materials. Subject to the prior approval of each party, KeyWordTargets.com may elect to issue a joint press release announcing the Client's marketing partnership with KeyWordTargets.com, which approval shall not be unreasonably withheld.

MINIMUM AGE REQUIREMENTS:

No person under the age of 18 is allowed to participate in our program unless written permission from a parent or legal guardian, notarized, signed and dated, is sent as an email attachment to info@popunderadvertise.com
